New Brunswick battle sports expense Voted into legislation

expense 72, new Brunswick’s battle sport Act, has passed third reading today making new Brunswick the most recent province to offer a legal framework for expert as well as amateur battle sports complying with recent amendments to Canada’s Criminal Code.

The Act regulates both amateur as well as expert battle sports.

On the amateur side boxing, judo, karate, tae kwon do as well as wrestling are ‘prescribed’ battle sports.

The listing does not include amateur MMA although section 2 enables the government to add MMA  and other sports to the listing by regulation.

The Act enables the government to authorize Provincial sport organizations to “approve as well as regulate” amateur battle sports.  Once done these PSO’s will have monopoly powers to oversee their Camiseta Selección de fútbol de Irán respective sports.  Realistically, if a PSO can be developed for amateur MMA in the province a situation can be made to add the sport to the Province’s prescribed list.

The Act carves out one exception to the requirement for PSO oversight of amateur battle sports, namely the ‘educational institution’ exception.  Amateur battle sports can be held without PSO approval in “a school, university or neighborhood college…if the event is being held as a part of the institution’s curriculum or extra-curriculum programming“.

On the expert side, the Act produces a province broad battle sports compensation which will be tasked to authorize as well as control events in expert battle sports Camiseta Urawa Red Diamonds (with the exception of expert wrestling).  Here the act mostly mirrors other jurisdictions with a province broad compensation tasked with overseeing “combat sports” which are defined as “a sport in which fighters utilize striking, throwing, grappling or submission techniques, or a combination of those techniques”.  This broad meaning clearly captures MMA.  The compensation enjoys the common powers such as issuing licenses for events as well as event participants, as well as a hold of administrative as well as investigative powers to guarantee compliance.

Lastly, section 42 of the Act strips municipal commissions of their powers bringing a province broad design to the oversight of battle sports in new Brunswick.
